September 30, 2026 Grandfathering Deadline
Investors who file I-526E before September 30, 2026 may be grandfathered under current investment amounts ($800K TEA), subject to USCIS approval. This deadline is statutory — USCIS has indicated no extensions are anticipated. Consult your attorney immediately.
Retrogression May Add Years for Some Countries
The 10,000 annual visa cap and 7% per-country limit create a backlog for high-demand countries. Investors from China may face 10+ year waits; India 3–5 years; Vietnam 2–4 years. The Gantt timeline shown assumes no retrogression — your actual timeline may be longer.
