Content & Moderation Policy

Overview

EB5Visa.io is committed to maintaining a safe, compliant, and trustworthy marketplace for EB-5 investors, Regional Centers, immigration attorneys, and other professionals. This Content and Moderation Policy governs all user-generated content on the platform, including profile information, project listings, feed posts, comments, and messages.

Our moderation framework is built around the SEC Shield — an automated compliance scanning system that reviews all content before publication for prohibited language, misleading claims, and regulatory violations. All moderation actions are permanently recorded in our Blackbox Audit Trail in accordance with SEC recordkeeping requirements.

SEC Shield — Automated Compliance Scanning

How SEC Shield works: All content submitted to EB5Visa.io — including posts, project descriptions, profile updates, and comments — is automatically scanned before publication for language that violates SEC Regulation D, USCIS regulations, and FTC advertising standards.

The SEC Shield scans for:

  • Guaranteed return language (e.g., “guaranteed ROI,” “risk-free”)
  • Visa guarantee claims (e.g., “green card guaranteed,” “visa approval assured”)
  • False government endorsement (e.g., “government-backed,” “federally guaranteed”)
  • Unlicensed solicitation language
  • Misleading immigration status claims

Content containing flagged language is automatically held for human review before publication. Users are notified when content is held. Scan results and moderation decisions are permanently logged in our Blackbox Audit Trail.

Prohibited Content

The following types of content are expressly prohibited on EB5Visa.io and will be removed upon detection. Repeated violations may result in account suspension or termination.

🚫 Securities Law Violations

  • Guarantees of investment returns (“guaranteed return,” “risk-free,” “certain profit”)
  • Unregistered public offering solicitations outside of Reg D disclosures
  • False accredited investor representations
  • Misrepresentations about SEC registration or exemption status

🚫 Immigration Law Violations

  • Guarantees of visa approval, USCIS petition approval, or immigration outcomes
  • Claims implying USCIS endorsement or affiliation (“USCIS-approved”)
  • “Buying a green card” or similar transactional immigration language
  • Misrepresentation of TEA designation, I-924 status, or project USCIS standing

🚫 False or Misleading Information

  • Materially false project descriptions, financial figures, or job creation claims
  • Fabricated attorney credentials or bar admissions
  • Impersonation of government agencies, other users, or organizations
  • Unsupported success rate claims (“100% approval rate”)

🚫 Harmful or Abusive Content

  • Harassment, threats, or targeted abuse toward any user
  • Spam or unsolicited commercial messages
  • Content that violates applicable laws (defamation, hate speech, fraud)
  • Disclosure of other users' private information without consent

Permitted Content

The following content is actively encouraged on the platform:

  • Accurate project descriptions with proper risk disclosures and Reg D language
  • Educational articles and analysis about the EB-5 program, USCIS policy, and immigration trends
  • Attorney profiles with accurate bar admissions, proper advertising disclaimers, and verifiable credentials
  • Regional Center updates and compliance status disclosures
  • Investor questions and general inquiries about the EB-5 process (not specific investment advice)
  • Industry news, regulatory updates, and USCIS policy commentary with appropriate sourcing

Moderation Process

Content moderation on EB5Visa.io operates through three tiers:

Tier 1 — Automated Scanning (SEC Shield)

All content is automatically scanned at submission. Content triggering prohibited language filters is held for human review. Users are notified if their content is held. Allowed content is published immediately.

Tier 2 — Human Review

Content flagged by SEC Shield is reviewed by a trained moderator within 2 business days. The moderator may approve the content as-is, request edits, or remove it. All decisions are logged with moderator identity and rationale in the Blackbox Audit Trail.

Tier 3 — Legal Review

Content that may constitute securities fraud, immigration fraud, or other serious legal violations is escalated to our legal team and may be reported to the SEC, USCIS, FINRA, or other regulatory authorities.

Enforcement Actions

Depending on the severity and frequency of violations, enforcement actions may include:

  • Content removal: Prohibited content is removed without prior notice
  • Content editing: Minor violations may result in a request to edit before resubmission
  • Warning notice: First-time violations may result in a formal written warning
  • Temporary suspension: Repeated violations may result in temporary account suspension
  • Permanent termination: Serious or repeated violations may result in permanent account termination and forfeiture of any paid subscription fees
  • Regulatory referral: Potential securities fraud or immigration fraud will be referred to the SEC, USCIS, or FINRA as appropriate

All enforcement actions are permanently recorded in the Blackbox Audit Trail and cannot be retroactively modified. Users subject to enforcement actions will be notified via their registered email address.

Appeals Process

If you believe your content was incorrectly removed or your account was incorrectly suspended, you may submit an appeal within 30 days of the enforcement action.

To submit an appeal:

  • Email [email protected] with subject line: “Content Moderation Appeal — [your username]”
  • Include your account email, the content in question, and your explanation of why the action was incorrect
  • We will review your appeal within 5 business days and respond via email

Appeals decisions are final. EB5Visa.io reserves the right to uphold any moderation decision that we determine, in good faith, violates this Policy or applicable law.

If you encounter content that you believe violates this Policy or applicable law, please report it immediately:

We take all reports seriously. Reports are confidential and will not be disclosed to the subject of the report except as required by law or legal process.

Professional Standards

All professionals (Regional Centers, attorneys, developers, migration agents, broker-dealers) are held to elevated content standards:

  • Regional Centers: All project content must include required Reg D disclosures, accurate I-924/I-526 status, and USCIS-compliant job creation methodology. TEA claims must be supported by valid state designation letters.
  • Immigration Attorneys: All profile content must comply with ABA Model Rule 7.1 and applicable state bar advertising rules. Bar admission status must be current and accurate.
  • Migration Agents: Agents must disclose all referral arrangements and hold all required licenses in their jurisdiction of operation.
  • Broker-Dealers: All content must comply with FINRA Rule 2210. All compensation arrangements must be disclosed.

Professionals who repeatedly violate these standards may be subject to profile suspension, credential re-verification requirements, or permanent removal from the platform.
