SOF Documentation Lifecycle

The 5-Phase Source of Funds Journey

Every EB-5 I-526E petition requires a complete, unbroken paper trail from how money was earned → accumulated → converted → transferred → documented. Click each phase to see exactly what evidence USCIS expects.

Lawful Earning

Document how the capital was originally earned. Salary, business ownership, investments, or inheritance each require different documentary trails. USCIS examines the complete economic history of the investor.

USCIS adjudicators use a preponderance of evidence standard. The burden is on the investor to show every dollar is traceable to a lawful source with no breaks in the path of funds.

Income Type Matrix, Scenarios & Red Flags

Three tools Chinese investors and their attorneys use to identify documentation requirements, stress-test common situations, and spot problems before USCIS does.

Every income type requires different documentation. Match your source to the corresponding evidence requirements and complexity level before engaging your attorney.

Critical Guidance

PBOC / SAFE Quotas, Transfer Windows & The #1 Time-Saving Action

Three operational realities that every Chinese investor must understand before initiating any capital movement.

PBOC / SAFE $50,000 Annual Quota
Every Chinese citizen has an annual quota of $50,000 equivalent for personal outbound remittance under PBOC/SAFE regulations. For an $800,000 EB-5 investment, you will need: (a) 16 years of your own quotas, or (b) aggregate quotas from family members (spouse, parents, adult children), or (c) an approved business channel (FDI, trade settlement). The most common approach is family member quota aggregation — document each person's contribution separately.
Safe Transfer Windows — Timing Matters
Transfer funds outside of politically sensitive periods: National Congress sessions (October), National Day Golden Week, and Lunar New Year. PBOC tightens outbound approvals during these windows. Transfers initiated 60–90 days before your attorney filing deadline give adequate buffer for potential banking delays. Rushed or last-minute transfers that lack supporting documentation are a common avoidable source of I-526E complications.
Start Collecting Documents Now — Not Later
USCIS requires 5 years of continuous financial records. Chinese investors often discover that their bank only retains 3–5 years of detailed statements online. Branch requests for older records can take 4–8 weeks. Request all historical documents from your bank immediately — even before you have selected a project. This is the single most time-saving action a Chinese investor can take before beginning their EB-5 application.
The SOF Standard: Every Dollar Must Tell a Story
Chinese investors who receive RFEs (Requests for Evidence) typically have one thing in common: gaps. A missing bank statement, an unexplained deposit, a transfer with no paper trail. The solution is not a larger documentary package — it's a complete one. Work backwards from your bank statements, identify every transaction above $5,000, and source every one of them before you file. An experienced immigration attorney who specializes in Chinese EB-5 SOF documentation is the most important investment you make before filing.
